So we can use any of these..

Created by a resident of Afghanistan, Eritrea, Ethiopia, Iran, Iraq, San Marino, and possibly Yemen, and published in one of these countries13 Not protected by US copyright law because they are not party to international copyright agreements
Fixed prior to 1996 Works whose copyright was once owned or administered by the Alien Property Custodian, and whose copyright, if restored, would as of 1 January 1996 be owned by a government14 Not protected by US copyright law


So "Lili Marlene" and "You Can't Be True Dear" aren't copyrighted in the US (at least, not with their original lyrics).

A new version of the copyright duration chart, "Copyright Term and the
Public Domain in the United States," is now available at a new URL:
http://www.copyright.cornell.edu/public_domain/.
The biggest change is that, at the request of a user, two new sections have
been added.  The first is on published and unpublished sound recordings, and
the second is on architectural works.  Other small changes have been made to
clarify some of the problems other readers have identified.  In order to
facilitate printing, a PDF version of the file is available as well.
As you can tell, the chart is a constant work in progress, and I welcome
corrections or suggestions for improvements.
