The purchaser is never liable, only the person who makes the copy because
that's who committed the crime. This is why assistant engineers have lost
in court when they were sued for sampling vinyl that was used on hip hop
records for their employers' clients. It's also why several replicators have
recently had to pay 6 figure settlements.
