Organized by Kendra Roth and Gwynne Ryan, representing INCAA-NA This workshop provides an introduction to some of the legal considerations that may confront conservators of contemporary art, both in private practice and in institutional settings. Since December 1990, the vested interests of living artists or their estates have been protected by the Visual Artists Rights Act (VARA), granting new rights for American artists and consequently imposing a legal obligation on art conservators to preserve the artistic intent of the artist. In addition, conservators may find themselves in an unfamiliar dialogue between insurance claims adjusters, artists, and collectors. The process and pitfalls that conservators must know about when dealing with insurance claims and the obligations set by VARA will be discussed in the context of conservation ethics, project documentation, and conservation-client contracts. Scott Hodes specializes in corporate and art law, representing prominent artists such as Christo, and is an author of three books on art and the law. Robert O'Connell is a fine art advisor and an art historian with 25 years of insurance claims experience. John Griswold is a principal conservator of a well-established art conservation firm in Los Angeles.
