Of course it is easier to go ahead and photocopy in this situation. And you
would *most likely* 
not run into any trouble with that decision.  The chance that we might
suffer recrimination from 
a publisher or legal dept., however, led us to establish procedures where we
have Acquisitions 
order the reprint to demonstrate the "good faith" effort.  If the reprint is
not received after 
7 months, the order is cancelled and photocopying procedures follow.  This
satisfies our auditors, bibliographers, and conservative element in
administration.   Reputation is considered "hearsay".

It doesn't happen often enough for Acquisitions to grumble and throw stones
our way.
